King Sigismund II Augustus settles a dispute between the city of Lwów and the heirs of Kazimierz Hynek, ordering them to return documents and vacate the third share of the Zimnowodzki mill located before the Kraków Gate upon payment of the due sum. The monarch appoints a land bailiff to execute the intromission in favor of the city under a penalty of 1000 marks, with the assistance of the Starosta of Lwów.

Sigismund Augustus, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, etc., Lord and Heir. We hereby announce by this our letter to all and each person concerned and to those who shall gain knowledge of this. Since the case was referred to us from the court of our commissioners between the honorable mayor, councilors, and citizens of our city of Lwów, the plaintiffs, and the noble Andrzej, Stanisław, Jan, Zofia, and Jadwiga, children and heirs of the late born Kazimierz Hynek, and their guardians: the born Piotr Barzym of Głogów, Castellan of Przemyśl and Starosta of Lwów, Jan Sienieński of Pomorzany, and Klemens Klius, the aforementioned [burghers?], as well as others having a legal interest in this, due to the redemption of the third share of the mill called Zimnowodzki and the income pertaining to it, located before the gate of the city of Lwów called Kraków Gate, as all this is more broadly contained in the case files. And on the date hitherto adjourned, when both parties appeared legally before us through their representatives and procurators, observing this term, we, together with our advisors and lawyers, after examining the dispute of the parties and after diligently reviewing and considering the laws, privileges, and the decree of our parent of blessed memory, submitted by both sides before us, have judged that the decree of our parent of blessed memory, dated in Kraków on the Sunday of Sexagesima before Palm Sunday in the year one thousand five hundred and forty-seven, issued due to the non-appearance of the parties, does not contain any right of expectancy or perpetual donation against the provisions of the statutes of the Kingdom. Furthermore, that this case was brought regarding the third milling share, by virtue of which the citizens of Lwów, in accordance with the disposition of earlier letters, are obliged to account for the waters and other income of the city, for what purposes they are spent. Nor could the disputed late Kazimierz Hynek, upon the existence of the decree of our parent of blessed memory, cede [rights] to Jan Hynek, his son from adultery. And only now, in accordance with the wording of the decree, after the passing of Kazimierz Hynek, the father of the defendants, this decree of our parent of blessed memory should be brought to proper execution. Therefore, we rule that the defendant heirs of Kazimierz Hynek are obliged before the court of these our commissioners, to whom we hereby refer the parties within a peremptory term of six weeks from this date, to submit the original documents of privileges for the third share of the aforementioned mill called Zimnowodzki, to collect the monetary sum legally recorded therein and hitherto collected, and to vacate the possession of this third share. And from now on, we assign to the plaintiffs a land bailiff, whichever they choose for this purpose, legally assigned and appointed to them to accept the introduction into possession of the above-mentioned third share of the aforementioned Zimnowodzki mill and all profits, fruits, and income from it, under our penalty of one thousand marks in the currency and count of our Kingdom, established by the power of execution, so that they are not denied intromission into this third share. In the event of a lack of intromission, in order to execute this decree, through this our decree we refer the plaintiffs to the Starosta of that place and to our royal arm, where that third share of the mentioned mill is located, according to the form of law. In witness and more obvious testimony of which, our seal has been affixed to this [document]. Given in Lublin, at the General Sejm of the Kingdom, on the nearest Thursday after the feast of the Purification of the Blessed Virgin Mary, in the Year of Our Lord one thousand five hundred and sixty-nine, and the forty-fourth year of our reign.
