PRELATES AND CANONS OF THE METROPOLITAN CHURCH OF LVIV.
We announce by the wording of this [document] to all together and to each one individually whom it concerns, how before us at the general chapter, held in the current year on the Saturday before Reminiscere Sunday, appeared in person the venerable Abraham Wegelins, vice-senior [and] senior, and Tobiasz Nadarkowski, vicars of Lviv, on behalf of the venerable vicars of Lviv on one side, and the honest Melchior Terszowicz, cabinetmaker, on the other side, and submitted a certain arbitration award, or friendly settlement, drawn up between them regarding the plot adjacent to the cemetery of the Blessed Virgin Mary behind the Krakow Gate, called Stawińskie, by the most reverend Mr. Łukasz Kaliński, canon of Lviv, an arbitrator freely chosen by both parties, requesting with due diligence that we deign to approve, confirm, ratify, and decree that this same award shall have the force of perpetual validity; the wording of which award follows word for word and is as follows: —
After a long legal dispute between the venerable college of vicars of the metropolitan church of Lviv on one side and the honest Melchior Terszowicz, cabinetmaker, on the other side, regarding the plot adjacent to the cemetery of the Blessed Virgin Mary behind the Krakow Gate, called Stawińskie, both parties, departing from all judicial turmoil, proceeded to a submission to arbitration and chose the most reverend Mr. Łukasz Kaliński, canon of Lviv and provost of Busk, as a true and legitimate arbitrator, and having given their word of faith, they agreed that whatever he decides in this matter, both parties will accept as fixed and binding. Which said most reverend arbitrator, after careful examination and due consideration of the entire matter and after mature deliberation with lawyers, determined that the superior ownership (directum dominium) of the same plot, which was the subject of the dispute, belonged and belongs to the said college of vicars of the metropolitan church of Lviv. However, he awarded the right of use (ius utile) of the same plot to the said Melchior, the cabinetmaker, as a true and legitimate emphyteuta and to his descendants, in accordance with the provision of the law of hand-written record [?]. Furthermore, as a sign of recognition of the superiority and direct ownership, the said emphyteuta together with his descendants shall be obliged and compelled to pay annually to the college of vicars of the metropolitan church of Lviv four marks of the number and currency circulating in the Kingdom, that is, one mark in each quarter. The direct owners, that is, the said [vicars], shall preserve and defend their emphyteuta and his successors in the peaceful possession of the said plot. Furthermore, the said Melchior, the cabinetmaker, inflamed with zeal for divine worship, undertook to erect on the same plot two houses under one roof in the place adjacent to the cemetery at his own expense: namely, one for a priest, whom the same college of the lords vicars will choose and appoint to live in this house, and the second for a tenant, from whom the rent is to be used for the repair of both houses, and in good faith he promised to complete this within four years, on such a large space as will be designated to the emphyteuta by the commissioners of the venerable chapter of the metropolitan church of Lviv as sufficient. It shall also be permitted for the said emphyteuta and his successors to sell, lease, and turn these goods to any other more profitable uses, without, however, making any sale or in any other way disposing of them without the knowledge and consent of the said chapter of the metropolitan church of Lviv and the said college of the venerable lords vicars, under penalty of loss and deprivation of their right, should they or their successors act otherwise. Which award both parties accepted as law and promised to observe all and individual [of its provisions] under penalty of excommunication incurred ipso facto. And in testimony of all and individual things [followed?] the signatures of the parties and [the document] was marked with the sign and signed by the own hand of the most reverend Mr. Arbitrator. Done in the common chapter house of the most reverend lords prelates and canons of Lviv, in the residence of the above-mentioned most reverend Mr. Łukasz Kaliński, canon of Lviv, provost of Busk, in the [presence of] the parties [before] the same arbitrator, on the third day of the month of August in the year of our Lord one thousand six hundred and thirteen. We, therefore, considering that their request [was] [just] and legal, approve, confirm, ratify, and declare and decree that the said award in all and individual its points, clauses, articles, chapters, and conditions should retain the force of perpetual validity. In witness whereof, this [document], signed by the hand of the most reverend Mr. Procurator, [we have affixed] with the common seal. Done and given in Lviv on the first day of the month of March in the Year of our Lord 1614.
