Confirmation of the guild statutes (wilkierz) of the surgeons' guild in Lwów by King John III Sobieski
King John III Sobieski confirms the privilege of Sigismund III Vasa from 1612, which contains the confirmation of the statutes of the Lwów surgeons' guild from 1611. The document regulates the admission and examination of new masters, the rights of widows, the duties of journeymen and apprentices, and the prohibition of unauthorized competition by non-guild members (partacze).

JOHN THE THIRD, BY THE GRACE OF GOD, KING OF POLAND,
Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, Kiev, Volhynia, Podolia, Podlasie, Smolensk, Severia, and Chernihiv, etc.
We hereby make known to all and each, whom it may concern [...] that a parchment document was presented to Us, signed by the hand of the once most serene Sigismund III, Our Predecessor, and reinforced with the royal seal [...] whole and intact and free from any stain of suspicion. And it was petitioned to Us in the name of [...] on behalf of the illustrious Szymon Ziętkiewicz and Jan Bocheński, guild masters of the said surgeons' guild of Our city of Lwów, elected for the current year, in their own name and that of their entire guild, that We might deign to approve and confirm this document with Our royal authority, the wording of which [...] is as follows:
SIGISMUND III, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, etc., and also hereditary King of the Swedes, Goths, and Vandals. We hereby make known to all and each, whom it may concern, that a paper document was presented to Us [...] provided with the seal of Our city of Lwów, containing certain articles, or a certain ordinance of the articles of the surgeons' guild of Our city of Lwów, containing within itself sound [...], as follows:
The Councilors of the city of Lwów to all whom it may concern [...] the illustrious masters skilled in the surgical art in the year of our salvation one thousand five hundred and seventy-eight [obtained] a special foundation for their guild [...] which, however, we and our successors in office are free to increase, change, and remove according to the circumstances of the time [...]. The present masters, therefore, noticing that many things are still missing in those articles, which in particular serve for the greater respect of themselves, their people, and their apprentices, have obtained from Us anew a partial interpretation and partial supplement to that recent ordinance. Which articles we give and grant in the following order of words:
On the creation of new masters. A new master who wishes to become a master here in Lwów, whether a newcomer or a local, shall wait with one of them as a companion until the eighth day of the feast of the Most Holy Body of Christ. For on that day of each year, according to ancient custom, they are accustomed to hold their full assembly, and at it, they make the choice of one candidate aspiring to the rank of master. First of all, therefore, it will be worthwhile for him to send two honest burghers beforehand, who will recommend him to all [...], and at the same time ask them to enter him into the album of candidates; then, with sufficient documents, prove his legitimate birth and where he learned this surgical art, and finally, after his name is accepted into the catalog, deposit two marks of money into their chest. Then, at his request [...] staying in the city, he shall remain for two consecutive years directly with one of the masters whom he chooses, until he prepares himself more diligently for the examination or makes his honest conduct manifest to all during that time. Furthermore, before the end of the two years, in the first days of Lent, coming again to the assembled, the chosen one [...] shall ask to be admitted to the examination on the appointed day; for [...] the material of simple medicines and those necessary for this kind [...], so that they may be prepared in time, he shall give twelve florins for expenses. On the eighth day after the feast of Corpus Christi, with God's help, he shall proceed to the examination, where in the presence of all the masters, first regarding theory and skills in general, which commonly belong to surgical practice, when he answers properly [...] [belong to surgical practice, when he answers properly], finally, most thoroughly, according to their custom, he shall check the first trials of instruments, namely the razor for shaving and scissors for cutting hair, and the lancet for bloodletting. Then, to the same person proceeding to further medical trials, simple medicines will be presented for the preparation of three plasters, called by them: one Gratia Dei, the second Galmanowy called Galbeni, and the third for treating fractures; as well as two ointments: Brown and Egyptian. When he also answers well to the questions about them: what is the nature and power of those simple medicines, that is, in what degree of quality each of them is contained, as well as in what order the preparation of each of them should take place, or for what external injuries they should be successfully applied – then finally, if he prepares those plasters and ointments according to the art to the praise of all, he shall be created a master. And this by an irrevocable judgment, if not by the votes of all, then at least by the majority of the present masters, possibly with some penalty, as will be explained below. Having thus been created a master, that which according to their ancient custom he was obliged to treat all the masters with a feast, as they call it, he shall pay only thirty florins in Polish currency into their chest for the necessary needs of the guild, or he shall pledge to pay it at a certain designated time. And from then on, he will be allowed to accept the city law in the manner of other masters, and to hang basins in front of his house, and to keep journeymen in his workshop, and to train apprentices. He himself, as long as he is a master in the guild, under pain of obedience, shall be submissive to the elders in performing the ordered offices and guild duties. It is otherwise, however, with others who would not know how to answer the questions and prepare the trials of the art in the proper way: for such a one shall experience rejection at that examination for one half-year, during which he shall lay better foundations of skill either outside this city elsewhere with some proven and skilled master surgeons, or here with one of them. When he returns after the half-year, he will be examined again, and then he shall pay the guild five florins as a penalty for every significant deficiency in the examination; if he does not return, let him pay twenty-four and lose all his effort. Moreover, the one examined with a penalty, when he is finally accepted as a master, shall fulfill all and individual conditions that every new master is obliged to fulfill, as above.
To widows of masters, however, this special consideration is granted, that she who remains alive after the death of the master shall have free exercise of the craft as long as she behaves honestly in her widowed state, not only with one journeyman, but with the special consent of the masters also with two journeymen and one apprentice. If, however, this widow marries a companion skilled in the same art, he shall perform no more than four trials, which the guild will assign to him, for the rank of his mastership – after prior questions – and shall pay half of all expenses. This privilege should also be enjoyed by the sons of masters skilled in this art and journeymen of the same art, whenever they wish to enter into an engagement with a master's daughter, upon prior assurance of the certainty of the marriage.
On the behavior of journeymen towards masters. Any journeyman arriving in Lwów who is accepted by a master should not leave him until he has first remained with him for a half-year. Before his departure, however, he shall notify his master one month in advance, and if he happens to have such an urgent need to leave, he should, along with the said notification, provide another journeyman to his workshop, with whom the master will be satisfied. Having done this, without lingering here in Lwów, he shall go outside this city, wherever he wishes. Where, however, he leaves that master recklessly or insolently and goes to another, or dares to claim for himself the practice of the craft outside the guild, such a one shall have no return to this guild and its freedoms from then on.
On a foreign master arriving in Lwów: that he shall not practice this art contrary to this ordinance; similarly regarding those who interfere with their craft contrary to the laws of the guild; and on not keeping irrational people and servants affected by some infamy until they are cleansed; and on the disobedience of masters when they do not come when summoned to the guild – these articles, just as they were written in the original, under the penalties indicated there, should remain in intact use.
For apprentices accepted for a three-year apprenticeship, let such an order serve, that he who is presented to the guild shall be entered into the album of apprentices and from that entry shall pay twenty groszy. After the lapse of three years continuously from that time, for his incorporation into the body of journeymen, instead of a feast, he shall give fifteen florins, of which one part shall fall to the journeymen and the other to the masters for their chest. He himself, however, freed, should not leave his master earlier until he serves him for a half-year of the duties of a younger journeyman.
On not interfering with one another in treatments. None of the masters shall remove the dressing of another master nor interfere in his case until the first one has been satisfied for his treatment and effort, under penalty of half the payment received by the treating person, payable to the same master whom he hindered in the treatment.
On the treatment of injuries, where it concerns both the health of the patient and the good of the treating person himself and the good name of the entire guild: that he who treats him, having called one or two senior masters to himself, shall show those wounds and the method of treatment and, after consulting with them, shall conduct the cure, under penalty at the discretion of the guild to be imposed.
On the burdens of the same guild. Since this surgical art and practice, dealing with the alleviation of suffering and the health of the human body, is highly necessary to the Republic in times of peace and war, through which surgeons endure no small dangers and hardships, and in the original foundation of the guild this burden was placed upon them, that they should treat city servants and night watchmen of the city, whenever they are wounded in public service, in their turn free of charge, for which they are obliged to provide and equip armament from their own persons and homes on an equal footing with other burghers, nevertheless they are obliged in that first ordinance to provide one [armed man] in the name of the guild for the feast of the Most Holy Body of Christ – therefore they remain free and exempt from performing other burdens in the manner of craftsmen. Since we, the said councilors, recognize the above-expressed articles, enlarged in this way and for this reason by an addition, corrected by thought, softened by kindness, changed by prudence, having invoked the name of GOD Almighty, by the power of our laws and privileges as valid and permanent, we approve and ratify with this our letter with such a reservation as we are accustomed to use: that we reserve for ourselves and our successors in office the full power to increase, correct, change, or diminish them according to the circumstances and requirements of the time. And this correction of the present earlier ordinance we submit with the deepest humility to the highest authority and confirmation in the first place of the Holy and Most Serene Royal Majesty, Our Gracious Lord. Done in the presence of the then masters and surgeons: Krzysztof Gilic, Tomasz Worobell – guild masters, Andrzej Unger, Jan Kałuski, Fryderyk Gross, Teobald Stephanides, Stanisław Paszkowski, and Aleksander Worobell. In witness whereof, we have reinforced this [document] with the attachment of our seal. Given from our council residence on the nearest Saturday after the feast of St. Lucy, Virgin and Martyr, in the Year of Our Lord one thousand six hundred and eleven. Andrzej Mędrowicz, then mayor of Lwów.
And it was petitioned to Us that we might deign to approve, confirm, and ratify this document with Our royal authority. To which petition We, graciously acceding, approve, confirm, and ratify the document written above in all its points, clauses, articles, and conditions [...]. We wish, moreover, and decree that no one, of whatever state and condition they might be, neither personally nor through substituted persons, in any way or under any pretext, shall hinder the masters of Our Lwów guild in the practice of the surgical art [...]. If, however, anyone were detected in the city jurisdiction subject to the council office, then the office will be strictly obliged to restrain such a one and impose a fine of one hundred Hungarian ducats: half for itself, and the other half absolutely for the guild [...]. The same penalty in such a way and order shall fall to the castle office existing at the given time and to the guild. We also wish that foreign persons not belonging to the guild, commonly called partacze, shall not hinder the guild brothers [...]. In witness whereof, we have ordered this to be signed by Our hand and reinforced with the royal seal. Given in Warsaw, on the 11th day of March, in the Year of Our Lord 1612, of Our reign in Poland the 25th, and in Sweden the 19th year. Sigismund, King. Place of the royal seal.
WE, therefore, graciously acceding to the said request as just and in accordance with reason, have deemed that the present document of the Lwów surgeons' guild in all its points, clauses, conditions, and articles should be approved, confirmed, and ratified, as indeed, insofar as they do not contradict the law, we approve, confirm, and ratify with this Our letter, establishing that they are to have and maintain the force of proper and eternal durability. In witness whereof, we have ordered this [document] to be signed by Our hand and provided with the royal seal. Given in Warsaw, on the 6th day of April, in the Year of Our Lord 1691, of Our reign the 18th year.
John, King.

De Magistris novitijs creandis. Magister novi[tius] qui volet Leopoli hic Magister fieri sive advena sit sive domesticus, socium apud eorum aliquem expectabit, diem octavam festi Sacratissimi Corporis Christi. Qua scilicet anno quolibet ex observantia antiqua plenum habere solent suum congressum & in eo candidati unius Magistri gradum adspirantis delectum faciunt. Et exinde integrum jam illi erit & jus Civitatis more aliorum Magistrorum suscipere & ante ædes mansionis suæ pelves appendere & Socios in Officina sua fovere discipulosq[ue] instituere.
Hanc autem præsentis prioris ordinationis emendationem cum primis Sacræ & Serenissimæ R[egiæ] M[ajes]t[at]is D[omi]n[i] N[ost]ri Clementissimi authoritate suprema & Confirmationi humillime submittem[us]. Actum & præsentib[us] eo tempore Magistris & Chirurgis Christophoro Gilicio, Thoma Worobelli Cechmagistris, Andrea Vnger, Joanne Kaluski, Friderico Gross, Theobia Stephanide, Stanislao Paszkowski, & Alexandro Worobell. In cujus rei fidem præsentes has Sigillo n[ost]ro appenso communivimus. Datæ vero ex residentia N[ost]ra Consulari Sabbatho post Festum S. Luciæ Virginis & Martyris proximo, Anno D[omi]ni Millesimo Sexcentesimo Vndecimo. Andreas Mædrowicz tum temporis Proconsul Leopol[iensis].
Supplicatumq[ue] Nobis ut easdem literas authoritate N[ost]ra Regia approbare, confirmare & ratificare dignaremur. Cui supplicationi Nos benigne annuentes literas supra scriptas in omnibus earum punctis, clausulis, articulis & conditionibus approbam[us], confirmamus & ratificamus, [...] Volumus etia[m] ne personæ extraneæ a Contubernio non existentes vulgo dicti Partacze Contubernalibus personæ impedimento sint [...] In cujus rei fidem præsentes Manu N[ost]ra subscriptas Sigillo Regni communiri jussimus. Dat[um] Varsaviæ die XI Mensis Martij Anno MDCXII. Regnorum Nostrorum Poloniæ XXV, Sueciæ vero anno XIX. Sigismundus Rex. Locus Sigilli Regni.
NOS itaq[ue] Supplicationi dictæ uti justa & rationi consona, benigne annuentes præsentes Literas Contubernij Chirurgorum Leopoliensium in omnibus earundem punctis, clausulis, conditionib[us] & articulis approbandas, confirmandas & ratificandas esse duximus, prout quidem in quantum Juri non sunt contraria approbamus, confirmamus, & ratificamus præsentibus Literis Nostris, decernentes eas robur debitæ & perpetuæ firmitatis habere & obtinere debere. Parchment document in very good condition. Preserved silk cord in silver-red colors with a tassel, on which a red wax royal seal is suspended in a metal case (the seal is partially cracked and damaged at the edges). The document bears the autograph of King John III Sobieski and the signature and chancery note of Stanisław Michał Denhoff. The document transumes the privilege of Sigismund III Vasa from March 11, 1612, which in turn transumed the guild statutes (wilkierz) of the surgeons' guild enacted by the city council of Lwów under the leadership of proconsul Andrzej Mądrowicz on the Saturday after St. Lucy's Day 1611 (December 17, 1611).
