[p. 1r] IN THE NAME OF THE LORD AMEN. KONSTANTY HRABIA NA LIPIU LIPSKI, by the grace of God and the Apostolic See ARCHBISHOP OF LVIV, perpetual administrator of the Jędrzejów Abbey. In eternal memory of the matter. The pious works of founders and testators enjoy such happiness in this world that even in the dust they may shine with immortal life, and in the shadows of death glow, provided they are not flooded by the waters of Lethe. Since it is our duty to ensure that piety is not hidden and that the more sublime cult of the Supreme Deity does not suffer or have to fade with time, we hereby notify all and sundry who shall see, read, or hear this our letter, intended to have force for all eternity, and who shall in any way in the future become aware of it: That once the noble and famous Stanisław Maydeszewicz, councilor of Lviv, bequeathed in his testament ten thousand Polish zlotys, so that a chaplain, being currently a priest, presented by the noble and famous Tomasz Belli, councilor of Lviv, and the distinguished Michał Boim, doctor of medicine, secretary to His Royal Majesty, golden knight, Lviv juror, and their successors, and in their absence [p. 1v] by the noble and famous mayor and councilors of the city of Lviv, would celebrate every week throughout the year three offerings of the Holy Mass for him, the founder, and his parents and relatives: the first on Monday as a requiem, as on weekdays, with the first collect for one deceased, and this sung with a cantor and two primanists, and should this Monday be occupied by a double feast, then on another day free from obstacles. Similarly, on Friday of each week, a votive mass of the Passion of the Lord, also sung by the same voices as above. The third offering of the mass without singing every Saturday of each week, a votive mass of the Blessed Virgin Mary or of the occurring double feast. Furthermore, in each month, after the monthly Sunday of the Confraternity of the Most Holy Sacrament, on Tuesday or Wednesday, or another subsequent day free from obstacles, a requiem mass for him, the founder, and for the deceased members of the Confraternity of the Most Holy Sacrament, as well as for souls lacking intercession. Moreover, that on every Ember day this same chaplain, together with the aforementioned cantor and two primanists, shall sing vigils of one nocturn with lauds in the chapel of the metropolitan church of Lviv, called the chapel of the lords councilors, or literati. During solemn feasts and the large influx of people in the morning, he is to assist the very venerable penitentiary priests of the cathedral church in hearing confessions. During the exposition of the Most Holy Sacrament, he is to assist in a surplice and support and sing the office of the Most Holy Sacrament, customarily sung in the same chapel on Thursdays in the morning; and he is to remember in his divine service his founder and his family. By virtue of these mass duties and labors, from the annual rent of seven hundred zlotys derived from the aforementioned sum of ten thousand, he assigned to his chaplain five hundred zlotys annually, to the lord vice-custodian for the apparatus relating to the said masses thirty zlotys annually, to the sexton of the cathedral church for wine and wax forty, to the two bell-ringers for hosts and service annually [p. 2r] eight zlotys. To the cantor and two primanists for each individual offering of the Holy Mass, both requiem and of the Passion of the Lord, as well as for one sung nocturn with lauds for the dead – one zloty, namely to the cantor twelve groschen, and to the two primanists eighteen groschen to be divided equally, that is, which amounts to the same, to the cantor forty zlotys annually, to the two primanists sixty. For the costs of a lawsuit, should any arise, he allocated twenty-two zlotys annually, and this so that those twenty-two zlotys intended for the costs of a lawsuit be deposited by the said chaplain in a small chest in the archive of the cathedral church, with the knowledge and possession of the second key to the same chest by the vice-custodian of the same church, for a period of ten years; after ten years, in the absence of any litigation costs, they are to be turned over for the housing of the same chaplain or for some ornament of the altar erected and endowed in the said chapel of the lords councilors, and this in every subsequent decade for all eternity. Therefore, the very venerable priest Franciszek Długosz, doctor of sacred theology, Lviv penitentiary, chaplain of this same foundation, adhering to the ordinances and will of the popes and holy canons, humbly asked us that we might deign to accept, approve, and ordain with ordinary authority this pious intention of the testator, the noble and famous Stanisław Maydeszewicz, councilor of Lviv, and other things required by legal order. We, acceding to these requests, preserving the form and practice used in similar actions, first of all ordered to issue summonses against all and sundry persons claiming an opposing right and any interest in the above, as well as issued them with the proper and due deadline. Finally, on this day, at the appointed legal deadline, appearing personally before us sitting in the tribunal for the administration of justice and hearing cases, the very venerable priest Franciszek Długosz, doctor of theology, penitentiary, presented that his founder, the noble and famous aforementioned Stanisław Maydeszewicz, in his authentic testament drawn up in the year of our Lord one thousand six hundred and eighty [p. 2v] nine, and approved both in the noble and famous council office of Lviv, and in this our consistory in the year of our Lord one thousand six hundred and ninety, on Friday the fourteenth day of the month of April, bequeathed to the chapel of our cathedral church of Lviv called the lords councilors or literati, ten thousand Polish zlotys, and this by reason of the above-mentioned, specified, and in all respects expressed intention. And after the presentation of the authentic record of the same sum of ten thousand zlotys, taken from the hands of the entire noble and famous council magistracy of Lviv, where and as the above-written sum of the provisors was made before the council acts of Lviv by the noble and distinguished lord Benedykt Wilczek, doctor of medicine, councilor of Lviv, together with the honest Teresa Awensztokówna, his lawful wife, in the year of our Lord one thousand six hundred and ninety, on Saturday on the eve of the Sunday Jubilate, on and about the tenement house called Jelonkowska in the market square of this city, situated and standing right next to the tenement house called Małskisiotkówna, as well as after the presentation of the summonses legally executed by public announcement in the cathedral church of Lviv, he accused of non-appearance all and sundry interested defendants who did not appear; and because of their non-appearance, he humbly and with due submission asked that the record of the sum of ten thousand together with the rent made by the noble and famous Benedykt Wilczek, councilor of Lviv, doctor of medicine, in the year and day as above, and the pious intention of the founder described above and expressed above, consistent with the testament, in all and individual points, articles, clauses, and all conditions be confirmed, approved, ratified, provided with the power of ordinary authority and eternal durability, as well as with a decree issued for this purpose; that the said principal sum and rent be entered, included, and incorporated into the freedom and immunity of the church; and that on the rent from this same sum the chaplain or altarist in the mentioned manner in the cathedral church of Lviv, in the chapel of the noble and famous councilors otherwise called literati, be erected, [p. 3r] erected, founded, endowed, the burdens by reason of this rent imposed, and for their fulfillment under the burden of conscience and penalties according to our discretion imposed, obligated; the right of patronage and presentation granted, bestowed, attached to the noble and famous Tomasz Belli, councilor of Lviv, and the distinguished lord Michał Boim, doctor of medicine, juror of Lviv, and their successors, and in their absence to the noble and famous mayor and councilors of the city of Lviv, and other things concerning the benefice done, ordained, and adjudicated, and the letters of approval, confirmation, and erection in the usual form needed for this ordained and ordered to be issued, and all deficiencies that occurred earlier, supplemented. We, however, Konstanty Lipski aforementioned, first of all waiting longer for any interested parties summoned by the said summonses, who did not appear, deemed them disobedient to the law, as they justly deserved, and because of their non-appearance, willingly not only acceding to the pious wishes of the founder and the requests of the very venerable priest Franciszek Długosz, doctor of theology, Lviv penitentiary, but also accepting them with due kindness, in the first place the above-specified record of the original sum of ten thousand, authentically presented before us, together with the rent derived from it, in all and individual its points, clauses, articles, connections, and all conditions with ordinary authority we approve, confirm, ratify, place the power of ordinary authority and eternal durability as well as a decree for this. On this same principal sum and the rent derived from it, we erect, found, and endow an altarist, a current priest, in the chapel of the noble and famous councilors, otherwise called literati, located in the cathedral church of Lviv, imposing by reason of the rent burdens, so that the altarist, present and for the given time officiating, being a priest, every week two offerings of the Holy Mass [p. 3v] sung, that is on Monday or another subsequent day, if this Monday were obstructed, a requiem mass as on weekdays with the first collect for the deceased aforementioned founder, on Friday similarly free from obstacles a votive mass of the Passion of our Lord Jesus Christ, or of the day in case of a coincidence of a privileged day; the third offering of the mass read votive of the Blessed Virgin Mary or of the day every Saturday throughout the year [to celebrate]. Furthermore, on every Ember day, that is four times a year, after every Ember day, vigils of one nocturn with lauds for the dead by himself, the cantor, and two primanists serving in the cathedral church, not ignorant of musical singing – similarly as the requiem masses and of the Passion of the Lord specified above, sung by the same cantor and two primanists – he shall celebrate for his founder, the noble Stanisław Maydeszewicz, remembering his parents and relatives both in the mentioned prayers and in the daily office of the canonical hours. On Tuesday or Wednesday, or another day without obstacles directly following the monthly Sunday of the Confraternity of the Most Holy Sacrament in each month, a read requiem mass as on weekdays for the dead: the founder, members of the Confraternity of the Most Holy Sacrament, and souls deprived of intercession, he shall celebrate, sing, and read. Moreover, that the same chaplain or altarist during great solemnities and a not insignificant influx of people in the morning shall support the very venerable penitentiary priests of the cathedral church of Lviv in hearing confessions of sins – we impose, and for the fulfillment of the above, the altarist for the given time existing under the burden of conscience and the threat of the severe judgment of God we obligate; otherwise, if he were to watch less diligently over this his office and twice warned did not improve, the ordinary without any legal formalities and official process shall proceed to deprive him of this same benefice. The mentioned sum and the rent derived from it for the endowment and foundation of the said altarist according to the founder's thought we allocate, that is, so that by reason of the mentioned labor, office, and holy masses they receive: [p. 4r] the altarist five hundred zlotys annually; the cantor twelve groschen, and the two primanists eighteen groschen divided equally among themselves for each sung offering of the mass and office of one nocturn for the dead, counted separately, that is – which amounts to the same – the cantor forty zlotys annually, and the two primanists also sixty zlotys annually, to be divided into four quarters; the sexton of the cathedral church for wine and wax used for the mentioned masses forty zlotys annually; the vice-custodian of the same church by reason of liturgical apparatus concerning the mentioned masses thirty zlotys annually; the two bell-ringers for hosts and service eight zlotys annually – each altarist for himself, others from his hands, and this annually to be divided into four quarters. Whereas the twenty-two zlotys, which remain from the annual rent derived from the above-written sum, the altarist shall store every year in some small chest in the archive of the cathedral church, with the knowledge and with the second key to the same chest entrusted to the vice-custodian of the same church, to cover the costs of a lawsuit, should any arise around this foundation, or – in the absence of any expenses – after ten years with the knowledge of the vice-custodian of the cathedral church turn over for the ornament of the altar of the said chapel or for the acquisition of housing for the mentioned altarist; to which every altarist, present and for the given time officiating, will be obligated constantly and for all eternity in subsequent decades; which we designate, to the freedom and immunity of the church we assign, include, and incorporate. The right of patronage and presenting this altarist to the noble and famous Tomasz Belli, councilor of Lviv, and the distinguished Michał Boim, doctor of medicine, secretary to His Royal Majesty, golden knight, Lviv juror, and their successors – and should their number increase and they not be in agreement as to one, the majority of votes will decide; and in the absence of the mentioned successors – to the noble and famous mayor and councilors of the city of Lviv we grant, with this reservation, however, that as a current priest there be presented a man modest, learned, and capable not only of fulfilling the mentioned duties [p. 4v] of the mass and devotions, but also capable of hearing confessions. If, however, the above-written collators upon the vacancy of this benefice were to prove sluggish and did not present a candidate in the time appointed to laymen by canon law, the same right of presentation, adhering to the provisions of the holy canons, we deemed as belonging to the reservation, attachment, assignment, application, and allocation to the most serene ordinaries of the place and their ordinary office; as also hereby we approve, confirm, ratify, impose, erect, found, endow, obligate, designate, assign, include, incorporate, impose, obligate, grant, reserve, attach, assign, apply, allocate, and establish, and the letters of approval, erection, and others needed for this we ordain and order to be issued. All deficiencies, both legal and factual, should any occur in the above, with ordinary authority we heal and supplement, not only in the mentioned, but in every best way. In witness whereof we ordered this letter, signed by our own hand, to be strengthened with our seal. Given in Lviv and drawn up on the fourteenth day of the month of January in the year of our Lord one thousand six hundred and ninety-three, in the presence of the most illustrious, most venerable, and very venerable lords Stanisław Wawrenkowski dean, Erazm Wąsowski chancellor, Mikołaj Zychin doctor of both laws, prelates and canons of the metropolitan church of Lviv, and many others.
