KONSTANTY Z MROZOWIC MROZOWICKI, DOCTOR OF BOTH LAWS, ARCHDEACON AND ADMINISTRATOR GENERAL OF THE ARCHDIOCESE OF LVIV AT THE VACANT SEE [SEDE VACANTE], PROVOST OF BUSK AND ROHATYN.
In eternal memory of the matter.
That design of the supreme mind, which created the universe, fills the voids and empties the filled; and when it allowed the Ordinary See of the Archdiocese of Lviv to be vacant, it cared for its Church from on high in such a way that, at the very time of the vacancy of the see, it multiplies what was diminished by the judgments of fate with new increments of piety: that, I say, Supreme Shepherd of his Church, who strengthened us with the infallible proof of truth: “I will be with you until the end of the world”; after he took from the circle of the living the shepherd, the Most Illustrious and Most Reverend formerly KONSTANTY COUNT NA LIPIU LIPSKI, ARCHBISHOP of Lviv, perpetual administrator of the Jędrzejów abbey, is present with his flock, that is, the CHAPTER of the Metropolitan Church of Lviv, feeding it, expanding it, caring for it, and like a true, although invisible bridegroom, adorning this visible Bride of his. About which we, all the more so as at the beginning of our administrative office sede vacante listening with great joy, to all and singular who shall see, read, hear this our letter, having to have eternal and everlasting power, and in any way

in the future shall receive knowledge of it, we announce. How the Most Illustrious and Reverend Lord ALEKSANDER (greater than Alexander the Great himself, for he triumphs not over the powerful walls of the world, but with sublime piety), canon and ordinary preacher of the Metropolitan Church of Lviv, [pasted copperplate engraving with the Jastrzębiec coat of arms] provost of Halych, born of the formerly Noble TERESA KUROPATWIANKA from the first marriage, and the Noble KAZIMIERZ born of the formerly Noble TERESA of Truskolasy from the second marriage, the KUROPATWAS, brothers born to each other, sons of the formerly Noble PIOTR OF ŁAŃCUCHÓW KUROPATWA, like two fruit-bearing olive trees, whose minds and hearts were seized by pious devotion to God, their own and hereditary goods, in the text of the entry placed below and elsewhere immediately below regarding the location, situation, and other circumstances to be specified, for the foundation and erection of a new canonry in the Metropolitan Church of Lviv have recorded, and such a record before us and our court authentically presented, and asked that we deign to accept, approve this their salutary intention, praiseworthy resolution, and the record itself with ordinary authority, and to decide other things necessary according to the order and rule of law. Whose pious desire embracing with due kindness and zeal, and wishing to support them according to our duty and office and to bring them to effect as soon as possible, proceeding according to the form and manner customarily used and observed in such cases, first of all, letters of public summons [general crida] or public edict against all and singular thinking and claiming for themselves any contrary right and interest, whom jointly or severally, or in any way this matter concerned or could concern, so that we might not seem to violate anyone's right, we deemed it necessary to issue, as we have issued, and ordered them to be announced for proper publication or execution with a fair and appropriate deadline. When on the legal deadline of those summons letters, falling on this day, we sat before us and our court on the tribunal for the administration of justice and the hearing and adjudication of cases, appearing personally the above-mentioned Most Illustrious and Reverend Lord ALEKSANDER KUROPATWA, canon and preacher of Lviv, in his own name and in the name of the Noble KAZIMIERZ KUROPATWA, his brother, after presenting those letters of crida, executed by public announcement from the pulpit in the above-mentioned Metropolitan Church of ours of Lviv by the venerable Jan Puczeński, vicar of the same church, accused of non-appearance [contumacy] all and singular to whom the interest of this foundation and erection would belong, and summoned by the said letters of crida and not appearing on the day and deadline of today; and because of their non-appearance, he moved with due diligence that the record of the donation of the goods of the villages of Wołosów and Cucyłów, situated and lying in the Ruthenian Voivodeship, Halych land, with all the right, dominion, ownership, right of proximity, benefits, uses, fruits, incomes, rents, appurtenances and attachments of the same villages, both with manors, structures, buildings, granges, granaries, gardens, orchards, fields, meadows, fields, forests, groves, oak forests, thickets, brushwood, shrubs, copses, heaths, apiaries, honey-bearing trees, rivers, streams, brooks, rivulets, watercourses, waters and their flows, lakes, marshes, hayfields, large and small ponds and their outlets, fishponds, mills, millers and their measures, inns, innkeepers, as well as with subjects, peasants, cottagers, lodgers, hut-dwellers, both runaway and settled on the estates, with their labor, rents, tithes, tributes, taxes, pensions, transport services, day and night guards and all duties long since paid and rendered by them, and all generally conveniences and benefits now deriving and in the future able to derive from the same goods, by him and the mentioned Noble KAZIMIERZ KUROPATWA, his brother, before the Lviv castle starosta acts on the Saturday after the octave of the feast of the Most Holy
[f. 2r (image 5):]
Body of Christ the Lord, of the current year, for the benefit of the Most Illustrious, Most Reverend and Reverend Lords prelates and canons now and for the given time existing, and the entire Venerable CHAPTER of the Metropolitan Church of Lviv, for the purpose of founding from a new root in the same Metropolitan Church of Lviv [pasted copperplate engraving with the Jastrzębiec coat of arms] for themselves and their successors from the House and Family of the KUROPATWAS of the JASTRZĘBIEC coat of arms, or in their absence from the paternal line others joined by blood with the same House, a canonry declared — in all and singular its points, clauses, articles, bonds and all obligations has been approved, confirmed, ratified, provided with the power of ordinary authority and eternal durability, and at the same time a decree issued for this, the said goods with all their appurtenances and attachments assigned to ecclesiastical freedom and immunity, included, incorporated and incorporated into the property of the Church, and on them a canonry in the same Metropolitan Church of Lviv erected, founded and endowed, burdens and duties imposed, and for their fulfillment the canon for the given time existing under the burden of conscience obliged, the right of patronage reserved to them the founders, as long as they live, and after their death to their successors from the House and Family of the KUROPATWAS, and that to the nearest in the line, and letters of approval, confirmation, erection, obligation, reservation and others necessary for this decided and ordered to be issued in the usual form. The wording of which record follows word for word and is as follows: Done at the Low Castle of Lviv, on the Saturday after the octave of the feast of the Most Holy Body of Christ the Lord, of the same year one thousand six hundred and ninety-eighth. Before the Office and these Castle Starosta Acts of Lviv, appearing personally the Most Illustrious and Reverend Lord ALEKSANDER, canon and preacher of the Metropolitan Cathedral Church of Lviv, born of the formerly Noble TERESA KUROPATWIANKA from the first marriage, and the Noble KAZIMIERZ born of the formerly Noble TERESA of Truskolasy from the second marriage, the KUROPATWAS, brothers born to each other, sons of the formerly Noble PIOTR OF ŁAŃCUCHÓW KUROPATWA, being sound in mind and body, bypassing any proper court of theirs and setting aside their own jurisdiction, and voluntarily accepting this Lviv castle starosta one for themselves, their descendants and their goods generally all, as far as it pertains to this act, openly, publicly and voluntarily declared, and each of them separately for his own interest declared: That they, for the eternal glory of the Supreme Divinity, the multiplication and growth of Divine worship, their own and hereditary goods, that is, the villages of Wołosów and Cucyłów situated and lying in the Halych land, with all the right, dominion, ownership, right of proximity, benefits, uses, fruits, incomes, rents, appurtenances and attachments of the same said villages, both with manors, structures, buildings, granges, granaries, fences, enclosures, gardens, orchards, fields, meadows, fields, forests, groves, oak forests, thickets, brushwood, shrubs, copses, heaths, apiaries, honey-bearing trees, rivers, streams, brooks, rivulets, watercourses, waters and their flows, lakes, marshes, hayfields, large and small ponds and their outlets, fishponds, mills, millers and their measures, inns, innkeepers, as well as with subjects, peasants, cottagers, lodgers, hut-dwellers, both runaway and settled on the estates, with their labor, rents, tithes, tributes, taxes, pensions, transport services, day and night guards and all duties long since paid and rendered by them, and all generally conveniences and benefits now deriving from the same goods and

in the future able to derive, reserving or excluding nothing from the said property for themselves, their successors or anyone else, but as widely, far and around as the heritage of the above-mentioned said village goods extends and reaches in its boundaries and borders long since, distinguished and demarcated by boundary markers from other neighboring and adjacent goods, and as it concerned and belonged to the declarants — already from now and actually to the Most Illustrious and Reverend Lords prelates and canons now and for the given time existing, and the entire Venerable Chapter of the Metropolitan Church of Lviv, and that out of pure and sincere generosity, for the purpose of founding from a new root in the same Metropolitan Cathedral Church of Lviv for themselves and their successors from the House and Family of the Kuropatwas of the JASTRZĘBIEC coat of arms originating, or others joined by blood with the same House, a canonry — they give, donate, record and resign, as they have hereby given, donated, recorded and resigned, by title of pure, sincere, true, simple and irrevocable donation forever and for all time. Into which goods or said villages, hereby donated and resigned, the same Most Illustrious and Noble declarants to the same Most Illustrious donees and their successors real intromission and actual and peaceful possession, with immediate use and benefit of the same goods by any general minister [ministerialis] of the Kingdom and two noblemen, more easily chosen for this, by the power of this donation record officially to be taken and assumed, already from now and actually voluntarily give and allow, and the given and allowed neither by themselves nor by any persons subordinate and subject to them to disturb, deny, take away, disrupt or in any way violate; indeed, the same Most Illustrious and Reverend Lords canons of Lviv, their donees and their successors, from all and any legal claims of all and singular persons of any status, sex, degree, condition and dignity being, by reason of the said property in any way arisen, in every court and office of the Kingdom as often as it will be necessary, through all land prescriptions, as it belongs and relates to any land person, to protect, defend, release from eviction, liberate and intercede, and the said goods hereby donated from all rights, burdens, debts, bonds, submissions and any earlier and later records, dowries, marriage portions, reformations, life interests and any other title of rights in any way burdening and touching these goods, as well as from summonses, co-summonses and any announcements brought and to be brought on these goods, finally from profits and additions and all judicial processes obtained and to be obtained on the same goods, always to make and keep pure and free — themselves together with their successors, on and regarding their goods in general all movable and immovable, hereditary and pledged, and all sums of money possessed and to be possessed, they record and oblige. And this under the penalty of land damages, simply and without corporal oath to be taxed and adjudged by the declarants themselves and their descendants, in case of any transgression against this donation record and non-fulfillment of all and singular things contained in it, to the same Most Illustrious Lords canons and the entire Venerable CHAPTER of Lviv, their donees and their successors, to be paid,
[f. 3r (image 7):]
compensated and submitted to, and in no way to be avoided. Because of which land damages, in the above-mentioned way to be paid submitted and transgressed, and because of any thing and condition of this donation record not fulfilled, and yet having to be fulfilled, the above-mentioned Most Illustrious and Noble declarants, summoned by law together with their descendants, renouncing the proper court as above, before any court and office of the Kingdom, to which or whom they submit and incorporate themselves together with their successors and their goods generally all in this measure to answer, at the first summons of the above-mentioned Most Illustrious and Reverend canons and the entire Venerable Chapter of Lviv, their donees or their successors, peremptorily [peremptorie] they will be obliged to answer, appear, satisfy the law and accept any judgment together with their descendants. The first deadline, as well as all others successively following from this, always peremptory, by no general postponements, evasions, suspensions, defenses, protests, prescriptions, legal obstacles and all exceptions, motions, appeals and their support, matters of the Republic, military service, embassy inside or outside the borders of the Kingdom, peremptory deadlines of law, land prescription, war, interregnum and assembly, matter of seniority, minority of successors, true or ordinary illness, safe-conduct letters or arrest, appeal to evidence, to the evictor and in general by all legal means and defenses not avoiding nor in any way evading, indeed, renouncing them in their entirety, but to this donation record and all its contents, after paying land damages as often as it will be necessary, before the court to satisfy — themselves and their successors and their goods generally all to this obliging and burdening.
And immediately before the same office and the Noble Jan Franciszek of Mrozowice Mrozowicki, sub-judge, and Andrzej Zębrowski, land scribe of Lviv (with the currently vacant judicial office due to the promotion of the formerly Most Illustrious and Magnificent Hieronim Kuropatnicki to the castellanry of Kyiv), the above-mentioned Most Illustrious and Reverend and Noble KUROPATWAS, declarants, complying with the public law established in this regard, having touched their chests, declared in these words: “I ALEKSANDER and I KAZIMIERZ under faith, honor and conscience take God as a witness that I make this foundation from a new root from our own goods, having received no payment, without any secret agreement, but out of pure zeal and my own generosity, doing nothing to the detriment of the constitution and public law allowing for this”. Through this their personal declaration in the above. Place [Cross] of the Seal. Issued from the Lviv Castle Starosta Acts. Corrected by Korendowicz. Read by Pomarzański with the Acts. In the presence of the Most Illustrious and Reverend Jan Tomasz Józefowicz, canon of the Metropolitan Church of Lviv, secretary of His Royal Majesty, as well as procurator of the Venerable Chapter of Lviv, to this matter in his own name and in the name of the entire same Venerable Chapter

intervening, and to the requests of the Most Illustrious and Reverend ALEKSANDER KUROPATWA and the entire House of KUROPATWAS (accepting the donation made presented in our court) acceding, and asking for the confirmation and ratification of the same donation.
We, however, the ARCHDEACON and ADMINISTRATOR GENERAL of the Archdiocese of Lviv sede vacante above-named, acceding to the request and wish of the above-mentioned founders, after viewing first of all the said letters of crida legally executed, after viewing also and reading the above-placed record before the Lviv castle starosta acts in the presence of the Noble land judges and officials specially asked for this and descending to the Lviv castle starosta acts, mentioned in the act of the same donation record, declared, in our court re-presented, and having in mind the consent of the Most Illustrious and Reverend Jan Tomasz Józefowicz, canon and procurator of the Venerable Chapter of Lviv, to the approval of the same donation and the erection of the canonry in his own name and in the name of the same Venerable Chapter of Lviv judicially expressed, first of all any interested parties or those having to have an interest in any way in the future, summoned by the same letters of crida, waited for more than an hour of the court session, and in no way appearing nor hindering the effect of the letters of crida — as disobedient to the summons [contumacious], as they justly deserved by the order of justice, we deemed; and because of their non-appearance, this same record in all and singular its points, clauses, articles, connections, obligations and conditions all to approve, confirm, ratify, by the power of ordinary authority and eternal durability at the same time to provide and a decree to issue for this, the said goods of the villages of Wołosów and Cucyłów to ecclesiastical freedom and immunity to assign, incorporate and adjudge, and the same for the endowment and foundation of the gremial, or more strictly capitular KUROPATWA canonry to erect, found and endow we deemed appropriate, as we from then as from now approve, confirm, ratify, provide, assign, incorporate, destine, erect, found and endow; and burdens and duties due to these goods on the newly erected canon for the given time existing — that two read masses in each week, on any day he pleases, during the lifetime of the founders for the remission of sins, and after their late death for their souls, by himself or through his deputy in the Metropolitan Church of Lviv he should celebrate and fulfill — we impose, and to the fulfillment of these duties under the burden of conscience and the threat of the severe Divine Judgment we oblige. If it should happen that the Most Illustrious and Reverend Lord Founder is provided with this canonry and receives institution to it, we leave the fulfillment of the said duties to his freedom and discretion. Finally, the said newly erected canon for the given time existing to all other burdens, both inside and outside the church, burdening the Lords prelates and canons of the Metropolitan Church of Lviv of old foundations and belonging to be fulfilled, as well as to residence at the church together with other Lords prelates and canons under the penalty prescribed in canon law, in
[f. 4r (image 9):]
the same canon law regarding the residence of canons expressed, we oblige; and him to all and singular precedences, prerogatives, honors, freedoms, rights, immunities and privileges, daily distributions and any other incomes, which the remaining Lords prelates and capitular canons, both inside and outside our cathedral church enjoy and in any way can enjoy and will enjoy, we allow and he should be honored to enjoy, use, consume, possess and be honored with the same, we decree; to all prelacies of the same church, if and as far as he is elected to them, as well as to prestimonia and options by reason of seniority concerning him (with the exception of the option of the manses of the Lords canons of the old foundation, to which the newly erected canon for the given time existing will have no right, unless he is provided with such a manse by the founders or any other person) we declare him eligible for all future times. The right of patronage to the founders, as long as they live, and after their late death to those originating from the Family and House of the KUROPATWAS, and that to the nearest, we reserve and adjudge, with the addition of this condition, that in case of the occurrence of any vacancy of the said canonry, they should present the nearest person from the Family of the House of the KUROPATWAS of the JASTRZĘBIEC coat of arms, and in their absence another eligible and worthy person, joined by blood with the same House, otherwise originating from noble parents of both sides. Letters of erection, foundation, donation, obligation, reservation and others necessary for this we decree and order to be issued in the usual form. All deficiencies both of law and fact, if any have occurred in the above, healing and fulfilling. Done and given in Lviv, in the Year from the Nativity of Our Lord JESUS CHRIST one thousand six hundred and ninety-eighth, of the Roman indiction VI, during the pontificate of our Most Holy Lord Innocent by Divine providence pope of that name the Twelfth in the seventh year of his, on Friday the twentieth day of the month of June. Document in the form of a parchment codex (4 leaves, archival pagination/foliation: 4 sheets), bound in richly gilded red/maroon leather (on the front and back cover gilded floral-geometric borders, corners and a rosette on the back cover; on the front cover preserved old paper signature sticker: 'Lit. Jur. K. ad No 1 Consist. qnd spectans'). Leaf 1r contains a magnificent copperplate engraving with the coat of arms of the Lviv chapter / archbishopric (Jesus Crucified in a heart entwined with thorns) supported by St. John the Baptist and St. Stanislaus the Bishop. On f. 1v and f. 2r, small copperplate engravings with the Jastrzębiec coat of arms of the Kuropatwa family are pasted. The text transumes an entry from the Lviv castle books from the Saturday after the octave of Corpus Christi 1698 (Acta Castrensia Capitanealia Leopoliensia). The issuer is the administrator sede vacante after the death of Archbishop Konstanty Lipski (d. 1698). Autographs and handwritten signatures of Konstanty Mrozowicki and notary Piotr Makowski on f. 4r.
