[Front cover:] NEWLY ESTABLISHED LAWS, CONFIRMED BY THE MOST SERENE AUGUSTUS III, KING OF POLAND, granted to the Lwów Bookbinders' Confraternity in the Year of Our Lord 1744. [f. 1r] AUGUSTUS III, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podolia, Podlachia, Livonia, Smolensk, Siewierz and Chernihiv; and hereditary Duke of Saxony and Elector. We make known by this letter-privilege of ours to all and everyone whom it may concern: The law of the entire magistracy of our city of Lwów, dated the first day of October in the Year of Our Lord one thousand seven hundred and forty, granted to the famous and honest burghers of Lwów of the bookbinding craft, was presented before us, and it was petitioned to us by our councilors and the aforementioned officials that we approve and confirm the said law with our royal authority; which reads word for word as follows: We, the councilors of the city of Lwów, make known to all and everyone whom it may concern, that the famous and honest burghers of Lwów of the bookbinding craft, described below by their own names, having come before the full office – being admonished by our office during the recently held election of the offices of this city in the current year – have agreed and unanimously decided among themselves that the regulations of their bookbinding craft in this city, according to the customs of other crafts, should be strengthened and described by a certain law, customs, and articles for all time by them and their descendants, and that they should maintain a decent peace in their craft according to them. They requested from our office that we, according to the ancient privileges of our city, the decrees and customs maintained throughout the Kingdom, and the described Magdeburg law, first for the honor and glory of the Lord's name, and then also for the greater benefit of this city and the adornment of the aforementioned bookbinding craft, establish a confraternity of burghers and confirm the articles submitted in writing according to their customs with our official authority. The meaning of these articles is as follows: 1. We decree that the brothers gathered in the confraternity should treat one another with decent respect, so that inappropriate disputes do not occur among them, and also that no one should disturb or annoy another when he is casting his vote, that is, his opinion. Which the elders of this craft should observe, so that honesty, by the custom of the most serene king as well as the obligations of the noble magistracy, remains inviolable. And every accounting quarter, the privileges of the most serene king should be read with all respect point by point at the quarterly session, so that every brother may hear and know what he is to adhere to; and if he had something against his brother, he should complain before the guild masters. Which the elders, having recognized the justice, should judge according to the provisions described below in the points. Also, at the quarterly accounting session, the guild masters should select a quarterly treasurer, a third brother. And whoever would transgress against this provision is to give a fine of twelve groszy each time for the needs of the confraternity. [f. 1v] 2. If any master were to keep the tablet, that is, the sign by which the brothers are summoned to the confraternity, he is to be punished with a fine of three groszy for each master to whom the tablet does not reach; and if he were to lose it, he must immediately have another made under penalty of twenty groszy. And which of the masters would not be obedient in the matters of the confraternity arising from the council of the official lord and the elder masters, from him the journeymen are to be taken away – which is to happen with the knowledge of their lordships the president and the councilors – until he makes amends for his offense. Which master would not have journeymen, he should not be admitted to any guild offices. Also, if any master were to prove himself such toward the confraternity that he would carry secrets outside and spread them, such a one is subject to the same penalty and cannot have a place in the guild. 3. We also decree this: if it were to happen that some master of the bookbinding craft arrived in the city of Lwów from another city and would like to practice bookbinding, such a one should accept the city law, perform a masterwork just like other companions, present letters from that city, show a letter from the office, give satisfaction to the confraternity, and provide a treat for the brothers according to his means; and if he had performed masterworks and completed his journeymanship in that city, then he will be exempt from making works here, he should only give to the brothers' chest for guild needs forty-three zlotys and twenty groszy. 4. A master's son of the bookbinding craft, after learning, is to wander for a year and six weeks to other cities, and this for the purpose of gaining experience in the craft and customs; and if he would like to join the assembly, he must first work for half a year as a journeyman for the one to whom it will be assigned to him by the elder masters; having given testimony of his craft, he will be admitted to the confraternity among the brothers, however, he will be obliged to give an entrance fee of six zlotys, make half a masterwork, provide a treat for the brothers, and give to the assembly's treasury forty-three zlotys and twenty groszy; and when he fulfills this, he will receive a place in the confraternity of this same craft. 5. Also, he who marries the daughter of a master of this craft must fulfill the same: the master's son, after providing a treat, making half a work, and paying forty-three zlotys and twenty groszy, is to be accepted as a master and must serve his journeymanship. Also, he who takes as a wife a widow of this same craft with the remaining children is free from works, however, he must serve half of the journeymanship, provide a treat if he wishes, and give to the guild treasury forty-three zlotys and twenty groszy. A journeyman who would take a widow of this same craft without children after her deceased husband should make half a work, serve half of the obedience, and give to the confraternity what the others described above. To every widow having a boy in training after her deceased husband, registered in the confraternity, we allow to use him, she only has to hand him over before his release for twelve weeks to the elder lords, so that they may recognize him in the learned craft and release him. The boy is to be contracted with his master for another five weeks; and if it were to happen that he ran away and was gone for six weeks, no master should accept him for those years which he has already served, but anew. Widows and daughters of masters are to behave honestly in their state, for if any were proven of lewdness, such we remove from this craft and freedom; and whoever would take such a one into the state of marriage is to be removed from the entire craft or pay a fine according to the resolution of all the brothers, with the preservation of the right of appeal to the office of the noble council magistracy. 6. If it were to happen to such a master that he fulfilled everything toward the confraternity and did not have a journeyman, and there were few of them with others as well, then it will be permitted for him to bring a journeyman for himself from another city; and the letter with which he writes for the journeyman he must leave by entry in the confraternity chest as proof until the journeyman arrives, and this so that there would be no quarrel among the masters. Also, a master who has not paid the fees in the confraternity nor shown official letters and release is not allowed to keep a journeyman or a boy. 7. Since in this famous city of Lwów, bookbinders have city law and bear all burdens, and have many obstructors, therefore, to prevent this, we decree that no unauthorized worker [partacz] should dare to work or sell either in the city or in the suburb, nor run around fairs, towns, and villages with books, nor bind them. And if such a one were found, without any ceremonies, having reported this to the entire magistracy, meanwhile having caught him with journeymen either at home or on the street, all books that are found and works are to be taken and sequestered until the further decision of their lordships the councilors. In this point, it is permitted for the booksellers and merchants in [f. 2r] their shops to sell bound and unbound books, provided only that they were made by the Lwów bookbinders. There are also peddlers who allow themselves to sell various books, not having any permission from the bookbinders – such peddlers and peddler women the noble magistracy allows to be detained and their goods confiscated, so that the entire assembly of the bookbinding craft does not suffer obstacles. Also, that no bookseller, printer, or merchant should dare to commission any works to the above-mentioned unauthorized workers living both in the city and in the suburb as well as in other towns and villages, since the Lwów bookbinders can answer them with all works and will satisfy them. And if any bookseller or printer dared to give work to unauthorized workers, and was convicted of this and accused before the Lwów councilors, he will be obliged to pay a fine of fourteen marks, and the books, to which only the Lwów bookbinders manage to reach, they will be allowed to take for the needs of the confraternity. 8. Whoever among the booksellers or printers trading in books, not having learned this craft, would possess bookbinding tools or keep journeymen or apprentices, or himself would like to busy himself with this craft – to such a one it will not be permitted. If he dared to do so, with the knowledge of the councilors, the tools and bound books are to be taken, and he himself will have to pay the Lwów council any fine according to discretion and make amends to the office. 9. If any bookbinder from any city, town, or foreign village arrived here in Lwów, bringing bound books and selling them to booksellers, secretly evading customs and taxes – through which harm is done to the king's majesty, the entire Commonwealth, this capital city, as well as the entire assembly of the bookbinding craft – for this reason, it will be permitted for the elders of this same confraternity to take and confiscate such books, half of which will belong to the city, and the other to the informant. If a bookseller or peddler bought such books secretly, and was convicted by the Lwów bookbinders, such a one must return them with the loss of payment, and give the enacted fine to the Lwów council office. The same is to be understood about those who live in the Lwów suburbs and in jurisdictions, and who bring such bound books to Lwów, having no connection with the local confraternity. 10. We want and decree that no bookbinder of the Ruthenian religion should dare to bind books, both Polish and Latin, nor take any works from printing houses from booksellers and monasteries, nor do them in monasteries, because they do not want to keep the confraternity with us. Preventing this: if a bookbinder of the Ruthenian religion, not having the privilege of the confraternity, were making books and booklets both Polish and Latin, or if they were found with him against this provision, then with the knowledge of the Lwów office they are to be taken for this same confraternity in any place, however many of them would be found. Also, those trading in peddler goods should not dare to sell any books, unless taken from the bookbinders of the confraternity, under the same penalty expressed above. 11. Since we see that through the decline of the bookbinding craft in Lwów, the taxes of the Commonwealth and the city of Lwów are significantly decreasing, and this is because various people not having city law, sitting in other jurisdictions, pay no taxes either to the Commonwealth or to the city, and sell various unbound books and booklets in villages, markets, and stalls, never having learned this craft, taking away the earnings from our bookbinders remaining in the order of the confraternity, who bear all tax burdens on an equal footing with other Lwów guilds – therefore, preventing this, we decree that no printer or any other person, except for booksellers and Lwów bookbinders (who are allowed to sell such large and small bound books here), should dare to trade in them, under penalty of confiscation of such books and booklets and a fine of fourteen marks, of which half will belong to the Lwów office, and the other to this same bookbinding confraternity. 12. And since it has become very widespread that some booksellers and printers give books and booklets in sheets serving for worship to Jews for binding, as well as other various ones, having after all Lwów bookbinders – which happens with the scandal of Catholic people, with the mockery of writings and images contained in the books, with great contempt for the Lord God Almighty and common laws, and to the detriment of the bookbinders of the Lwów confraternity – therefore, preventing this, we decree that no one should dare to give any books or booklets to Jews for binding under penalty of loss of those books and a fine of fifty marks, of which half will belong to the Lwów council office, and the other for the needs of the bookbinding confraternity. Jews also should not dare to bind those Catholic books and booklets nor carry bound ones around the city under city penalties, and the Lwów bookbinders will pursue their rights before the voivodeship court. 13. Since the confraternity of this bookbinding craft in this famous city of Lwów was long ago established and founded, therefore we decree that the release, that is, the release of journeymen, should have validity from the Lwów confraternity itself to all [f. 2v] other cities, such as Kraków and Poznań. Since many masters of this craft live in cities and towns belonging to this Crown and, not keeping to the order of the dear confraternity, disorderly release apprentices, we want these released ones, for better training in the craft and honest release, to submit to an examination before the elder masters of this same confraternity according to proficiency in the craft and be released by them. The same is to be understood about Lwów bookbinders who have disorderly completed their years of learning. 14. If any master were to die, or a mistress, son, or daughter of such a master, the young masters should carry the body to the grave under penalty of 6 groszy. In the same way, the master's journeymen are to carry the coffin under the same penalty of 6 groszy. Also, all masters with their spouses and journeymen should be at the funeral and at the funeral mass, and not leave until after everything, under the penalty described above. 15. A master who would entice a journeyman or apprentice away from another or accept him not in accordance with the order, for this offense should give to the brothers' chest 15 marks and immediately send this journeyman back to the master from whom he was brought. At this, no master can keep an apprentice on trial longer than four weeks under penalty of 2 marks. And after four weeks, the master should register him in the confraternity during the session, with the knowledge of all the brothers of this same confraternity; for the registration itself he is to pay two zlotys and 15 groszy, at the deregistration also 2 zlotys and 15 groszy, to the scribe six groszy, and treat the journeymen according to custom. No Lwów master of this bookbinding craft should keep unreleased boys as journeymen, until first one is recognized as a journeyman, under penalty of ten marks: half for the office, the other for the confraternity. 16. When it comes for any journeyman to perform his reception into the journeymen, it should take place in this way: first, after the release, within two weeks of his own free will, according to his means, he is to provide a treat for the journeymen at his master's, where he remains in service; then within the next two weeks he is to make the registration in this same inn and give a silver jewel according to custom, worth half a minted thaler; and then he is to undergo the reception according to the time designated by the elder masters, for without this he cannot call himself a full journeyman. At this, whoever as a journeyman of the bookbinding craft would arrive from outside to this local city of Lwów, let him not dare to hire himself where he himself would like, without the knowledge of the elder masters, but he should settle where it will be assigned to him with their knowledge. 17. If a journeyman wanted to leave his master and go on a journey to another city, he cannot leave his master until he first returns the works entrusted to him, under penalty of two coals; also before the Lwów fair, before Easter, before Pentecost, and before Corpus Christi, he cannot take his leave four weeks before these days, and after this time for two weeks, under penalty of two coals. A journeyman of this craft who would get married is allowed to work as a journeyman as long as he wants; but if he wanted to become a master, having a wife, he must work for a year and six weeks for one master and perform a work according to the order described above; and if he wanted to remain a journeyman, he is allowed, but his wife has no right to do anything with books or help her husband in this. 18. A master who released an apprentice from his years of learning should, after the release, keep him with him for half a year of work, which is called 'span', and the master is not to pay him more than seventeen groszy; but to a journeyman who equals the master's hand – one zloty. And if the journeyman went on a journey and was returning from the journey, he is not to work for another master, but for the one with whom he learned, he is to work for two weeks. Every journeyman of this craft who would not come on time to his master for dinner or did not sleep at home is to be punished in the confraternity and must give seventeen groszy to the chest of this same confraternity and provide a witness of his lodging. 19. A journeyman working for his master who would like to set out on a journey should announce this according to custom two weeks in advance, and after two weeks he is to settle accounts with his master, say goodbye honestly, and go to the elder masters with a request for work; and if he had the will to wander, [f. 3r] it is not to be forbidden to him. He should report to his master, as expressed above, and after two weeks the journeymen are to provide him a farewell treat according to custom and send him off honestly on his way. A journeyman who announces his journey to his master, and then would not want to go on the journey, even though he received the treat, is to give a penalty to the confraternity chest in the amount of two coals and pay the journeymen for that treat. A journeyman who has set out on a journey is not to work anywhere secretly or in town halls, but is to wander to the bookbinding order of the capital city; if this were proven against him, he should be punished. 20. The journeymen are to gather for a meeting at the confraternity and there every journeyman is to give twelve groszy to the chest for the support of a sick companion. And when a journeyman falls ill at his master's and is ill for a week, if the master could not keep him longer, he is to notify the elder masters about his case; then they should keep him from the brothers' chest for the second week, and if he were ill longer, they are to try to find a place for him. If he were to die, the elder masters are to sell his clothes and for that, as well as for the money earned by him, provide him a funeral. 21. Whoever among the journeymen of this craft would like to join the bookbinding order, it is necessary that he be well-trained and proficient in his craft; he must work for his master in a position for a year and six weeks. No one is to be admitted to the brotherhood who would not show two letters: one from the office, the second about the release in this craft, certifying under seal that he learned for five years. At this, he is to ask the senior lords for the summoning of an assembly of the confraternity lords of the bookbinding craft, at which assembly he should undergo an examination. 22. After completing this, that journeyman will have to work for a quarter of a year for one master designated by the senior lords; at this, from that master he is to seek admission to the confraternity, and this so that he may be examined whether he is well-trained in the profession, and give a trial of his craft. But first, he should wander for two years, unless he was already a wandering journeyman. Then he is to ask for the designation of works that he is to perform: if he is a master's son – half the works, if an apprentice who registered for five years – this one is to make all the works and satisfy the described duties that will be indicated to him. First, he is to perform a trial called works at the one among the elder masters whom the brothers from the confraternity will designate. To the work, no one is to be admitted, only he who is of legitimate birth, well-trained in his craft, and released; and thus the masterwork of the bookbinding craft is to be performed: 23. Every journeyman of this craft is to perform the work personally, with his own hands, at his own expense at the elder master's, where it will be designated to him – both the copy and any other expense belonging to these works. These works are to be as follows: Roman Missal in folio, Roman Breviary in quarto with a coat of arms, in one part a diurnal, in octavo the grammar of Emmanuel Alvar. These works are to have gilded edges, be bound in red leather with embossings on the leather and Gdańsk fittings; in Polish: prayer book 'Crown', 'Office', 'Royal Collection', 'Vineyard', 'Calvary Flowers'; these works with gilded edges, in morocco or goat morocco, with Gdańsk fittings, are to be made without the slightest flaw. And when he is making these works, the master is to oversee this work, ensuring that it is not done by someone else; the journeyman is to let the elder masters know when he is starting work on the works, and without them, he cannot do anything. And when he finishes the designated works, he should show them in the confraternity to all masters for evaluation. If there were any criticism upon submitting these works, they are not to recognize them as fulfilling the requirements, but he will again have to work for a quarter of a year for a master whom they designate to him, so that he may better gain experience in the work. Then he is to again submit the above-described works for evaluation; and if he still did something imperfectly, he is given another half a year by the masters. After showing the works again and recognition by all masters, if they are accepted, he should pay the confraternity fee; upon submission, he is to declare whether he has the will to become a master in the bookbinding craft; he is to give an entrance fee of twelve zlotys to the chest for guild needs. 24. Considering all crafts, that no one can be called a master, only he who properly and duly performs his work, therefore we want and decree that no journeyman without making the works be accepted into the assembly, since he did not show his work, and he cannot buy it off with money. These works should be presented in this way: first, the young master is to present his works one by one before that deputy brother; the elder lords should examine and observe every thing in the work, whether it is duly made, passing it one to another for judgment, and no one should disturb another under penalty of eight zlotys. And thus each of the works, one after another, is to be presented, and the confraternity scribe is to diligently record which work submitted by the younger master is to be recognized and accepted by a majority of votes. 25. If any journeyman wanted to join the bookbinding confraternity, he should accept the Lwów city law, and living in Lwów, accept the bookbinding confraternity according to the laws and orders belonging to it and in everything act according to these laws and orders. And if he did not want to accept the confraternity, no one is to allow him to perform the bookbinding craft under penalty of fifty marks, which penalty, just like others, is to be turned to the needs of the guild. When accepting such into the confraternity, they will not make difficulties, but for the reception into the entire confraternity, besides the entrance fee according to his discretion and according to his means, he is to pay seventy-one zlotys, divided into three installments to be paid to this bookbinding confraternity – for each installment forty-three zlotys and twenty groszy – and one treat according to his will and means upon joining the confraternity he is to provide. 26. And when he behaves duly according to all the described points, he is to ask the masters for the designation of his place in the assembly; having received the designated place in the confraternity, he should give forty-three zlotys and twenty groszy to the chest upon his entry; and it is to be ordered to him by all the masters how a master belonging to the confraternity of this bookbinding craft is to behave. Having joined the assembly, he will have to perform the services of this same confraternity for one year and six weeks according to the recommendations of the elder lords, until another follows after him. We, therefore, the mentioned councilors of the city of His Royal Majesty of Lwów, having recognized and well-considered the order of the above-described articles, which the famous Stanisław Strzeszyński and Jakub Stroński, masters of the bookbinding confraternity, burghers of Lwów of the Polish religion, submitted for reading, consideration, and confirmation – because for reasons just and decent for the order of masters, journeymen, and boys of the bookbinding craft it was established and nothing is found in it that would not serve the common benefit of this city, the adornment and honesty of this craft; and especially wanting that thanks to such an order and provision, on the model of other guilds, also these masters, journeymen, and apprentices of the bookbinding craft, present and future, remain in all obedience, honest customs, and their mentioned duties – having called for God's help, by the power of the laws and privileges granted to us by the most serene Polish kings, our gracious lords, by the authority of our office we have established a confraternity for them. By this letter of ours, we henceforth establish it, the articles described above all and each one separately for all time we confirm and strengthen, promising in the name of ourselves and our successors in the council office that we will keep all masters of the mentioned craft and those who will belong to the said confraternity at the above-described orders and articles inviolably and will defend them against those who would be against them, under penalty. To which above-described points and articles the masters of this craft, desiring to maintain good order at once, chose for themselves for this year unanimously as seniors the famous Stanisław Strzeszyński and Jakub Stroński and presented for approval; whom we, until the next election, have confirmed by the power of our office. For better faith, certainty, and testimony, we ordered the seal of our council office to be pressed. Done in Lwów at the town hall on the first day of October in the Year of Our Lord one thousand seven hundred and forty. W. J. Kupiński, city scribe of His Royal Majesty of Lwów. [f. 4r] We, therefore, AUGUSTUS, KING, having graciously inclined to the mentioned request, the presented law and articles expressed above in their content in all points, clauses, and conditions we decided to approve, approve, and strengthen, as well as by this letter-privilege of ours – insofar as they are not contrary to common law – by our authority we confirm, approve, and strengthen, and we desire that they have perpetual force. For which, for better faith, having signed with our own hand, we ordered the crown seal to be pressed. Given in Grodno, on the 22nd day of the month of November in the Year of Our Lord 1744, of our reign the XII year.
